Under New Jersey §2C-14-2, there is a range of types of situations that could lead to a charge of sexual assault. In cases in which the person accused was in any position of authority, such as a teacher, coach, pastor or other person in a supervisory position or one who holds disciplinary power over the alleged victim, once again, the charge will be a felony crime of the first degree.
Penalties Far Beyond Prison Time in Sexual Assault Convictions
The penalties imposed in these cases are extensive; not only will the convicted person be required to serve 85% if the sentence imposed (which can be as high as 20 years in state prison), that person will also be required to register as a sex offender under Megan's Law. This sex offender registry is available to view easily by anyone with a mobile device or computer, and will show your picture, the offense for which you were convicted, and your address. An innocent person can have their life essentially ruined if convicted for the crime of sexual assault. After the time has been served, there are further penalties imposed, and any person convicted of the crime will be prohibited from participation in any youth serving organization. There are restrictions regarding parole and the requirement of Community Supervision for Life (CSL). This process imposes other restrictions upon convicted offenders, and allows for more charges to be filed if the requirements and terms are not fully met. It is not possible to be free from CSL unless 15 years have passed with no violations and even then it could be denied.
